The Finding

MANILA — The House of Representatives’ justice committee found probable cause to impeach Vice President Sara Duterte in proceedings that were livestreamed, advancing the impeachment effort that will move to the full House for a vote in early May. Sara Duterte’s team rejected the ‘probable cause’ finding, consistent with the position she has maintained throughout the proceedings: the charges are politically motivated and the process is a Marcos administration tool rather than a genuine accountability mechanism. The House remains dominated by Marcos administration allies. The finding was predictable. The plenary vote is the next milestone.

The Charges This Time

The charges in the 2026 impeachment complaint include: threatening to assassinate President Marcos, First Lady Liza Araneta-Marcos, and former Speaker Romualdez; misusing public funds (the confidential funds issue that has been the focus of the committee hearings); non-declaration of assets; abuse of power; and bribery. The charges are more extensive than the 2025 impeachment complaint. The committee hearings have built the evidentiary record that supporters call ‘smoking gun’ evidence and that the SCMP reports Sara Duterte and her spouse are calling a ‘damage control’ situation.

What a Senate Trial Means for 2028

A guilty verdict by the Senate acting as an impeachment court would disqualify Sara Duterte from running for office — including for the 2028 presidency that she officially declared on February 18, 2026, becoming the first declared presidential candidate for 2028. The specific consequence of the Senate trial is the political weapon that the Marcos camp is deploying: an impeachment that proceeds to the Senate creates the legal mechanism for removing Sara from the 2028 ballot. Whether the Senate constitutes an impeachment court is the question that Senate President Sotto and the Marcos camp’s Senate allies will manage.

The 2025 Precedent

The 2025 impeachment reached the Senate, which delayed establishing an impeachment court and eventually remanded the case back to the House. The Supreme Court nullified the case in July 2025 on procedural grounds. The 2026 complaint was filed after the one-year ban lapsed in February 2026. House leaders have said they are guided by the Supreme Court ruling to avoid the procedural issues that caused the 2025 nullification. The second attempt is designed to survive the procedural challenge that ended the first.
