The Constitutional Requirement

MANILA — The Philippine constitution requires the Senate to constitute itself as an impeachment court once the House transmits articles of impeachment. The 2025 experience demonstrated that ‘required to constitute’ and ‘immediately constitutes’ are different things: the Senate delayed in 2025, creating the space for the procedural complications that eventually produced the Supreme Court’s nullification of the case. The 2026 impeachment is designed to withstand those procedural complications. Whether the Senate constitutes quickly or slowly remains the Marcos camp’s leverage.

The 160-180 Vote Projection

Liberal Party MP Edgar Erice projected that 160-180 of the 318 House members will vote yes for impeachment in the plenary vote expected in early May. The constitutional requirement for impeachment in the House is one-third of all members, which is approximately 106 votes. The projected 160-180 is substantially above the threshold, indicating that the impeachment will pass the House with room to spare. The House vote is not the uncertain outcome. The Senate trial is the uncertain outcome.

The Senate Mathematics

The 24-member Senate trial would require two-thirds, or 16 senators, for conviction. The Marcos administration’s Senate allies and the Duterte-allied senators create the specific Senate political mathematics that determines whether conviction is possible. A Senate with more Duterte allies than the 2025 Senate — which the midterm elections could produce if the RAGE Coalition performs well — would be a Senate less likely to convict.
